FAULKNER, Justice. David White was indicted on a charge of First Degree Murder. He was convicted in the Circuit Court, Perry County, Virgis M. Ashworth, J., of First Degree Manslaughter and sentenced to ten years in the state penitentiary. He filed an appeal in forma pauperis with the Court of Criminal Appeals. On February 28, 1975, the case was transferred to the Supreme Court.
