2 Plaintiff brought this action to recover on an unpaid check drawn on the Liberty National Bank of Oklahoma City, alleging that the check was signed and delivered to the plaintiff by the defendant for a valuable consideration; that upon presentation to the bank, payment was refused for the reason that there was no account in the name of the defendant. The defendant admitted giving the check but denied liability on the check because of failure of consideration.
